Dette speciale omhandler miljøvurderingaf lokalplaner, og hvordan kommunen(myndigheden) vurderer, om noget har envæsentlig indvirkning/påvirkning på miljøet.Dette fremstilles i specialet i to dele: Del I,Problemanalysen og Del II, Hovedanalysen.Problemanalysen tager udgangspunkt ierfaringerne med VVM-direktivet og detundersøges, om disse også er gældende forimplementering af SMV-direktivet i forbindelsemed miljørapportens afgrænsning.Direktiverne er implementeret i MVL og detundersøges med baggrund heri, hvordankommunerne afgrænser miljørapportensindhold, samt hvilke udfordringer og svaghederder er herved.Hovedanalysen undersøger, hvornår der erkrav om miljøvurdering. Herunder hvordanscreeningsproceduren og vurderingen af væsentlighedsbegrebetkan medvirke til en mereensartet metode, som beskriver, hvornår derved screening efterMVL § 8, stk. 2, er krav ommiljøvurdering. Undersøgelsen resulterer i enrække anbefalinger, som skal medvirke til etmere ensartet vurderingsgrundlag forud forscreeningsafgørelsen jf.MVL § 10.This master thesis deal with environmental assessment of local plans and howthe municipality(authority) assesses whether something has a significant impacton the environment. This is presented in the master thesis in two parts: Part I,The Problem Analysis and Part II, TheMain Analysis.The Problem Analysis is starting from the experience with the EIA-Directiveand it is examined whether these also apply to the implementation of the SEADirectivewith regard to the delimitation of the environmental report. The directiveshave been implemented in the danish Environmental Assessment Law and itis examined with reference to this how the municipalities delimit the content ofthe of the environmental report including which challenges and weaknesses thereare.The Main Analysis examines when the requirements for the environmental assessmentare meet. This includes how the screening procedure and the impactsignificance determination can contribute to a more similar method for whenthe requirements for environmental assessment is meet after screening accordingto the Environmental Assessment Law, Article 8.2. The study results in anumber of recommendations that must contribute to a similar basis for the assessmentprior to the screening decision cf. the Environmental Assessment Law,Article 10.
